Joint Filing

A husband and wife may file a joint petition for chapter 7 or chapter 13 bankruptcy. Unmarried couples, persons in a civil union and others can not file together no matter how intertwined their finances may have become. Whether a couple should file together, or whether only one spouse should file, is a complicated question involving an analysis of who owes what debt, who owes what property and other factors. Eligibility

The following persons are not eligible for a chapter 7 discharge:

1. A person who has been granted a chapter 7 discharge in a case which was filed in the last eight years;

2. A person who has been granted a discharge in a chapter 13 case filed within the last six years, unless 70 percent or more of the unsecured claims were paid off in the chapter 13 case;

3. A person who conceals, transfers, or destroys his or her property with the intent to defraud his or her creditors in or the trustee in the chapter 7 case; and

4. A person who falsifies financial records or makes false statements in the connection with the chapter 7 case.

5. Persons who have been involved in another bankruptcy case in the last 180 days, where that case was dismissed on certain grounds.

Any person who does business in, or resides in the U.S. may file for relief, so you do not need to be a citizen to file for bankruptcy relief.

Persons who are self employed may file for chapter 7 relief. Persons who work for their own business which they own may also be able to file and keep their business if the facts and circumstances are favorable.
