What Debts Can Not be Eliminated In A Bankruptcy Case? In a Chapter 7 case, almost all types of debts can be eliminated. It does not matter how great or how little the amount of the debt is. The following types of debts are not dischargeable (that is to say, you can not get rid of them) in a typical chapter 7 case:(1) Most tax debts and debts that were incurred to pay tax debts; (2) Debts for obtaining money, property, services, or credit by means of fraud or submission of a false financial statement; (3) Some debts that are not listed in the debtor's Chapter 7 forms; (4) Debts for alimony(maintenance) or child support; (5) Debts incurred because of the intentional or malicious acts of the debtor.; (6) Debts for fines and penalties owed to government(s); (7) Most Debts for student loans; and (8) Debts for personal injury or death caused by the debtor's drunk driving.
